The Club at Brookstone — Golfer Terms & Conditions

Effective Date: July 2, 2025

By booking a tee time or otherwise entering the premises of The Club at Brookstone (“Club,” “we,” “our,” or “us”), each player (“Golfer,” “you,” or “your”) affirms that they have read, understood, and agreed to the following Terms & Conditions. If you do not agree, do not book or play.

1. Reservations, Cancellations & No-Show Charges

1.1 Reservation Guarantee. A valid credit or debit card must be placed on file at the time of booking to guarantee all tee-time reservations.
1.2 Cancellation Window. You may change or cancel your reservation up to two (2) hours before your scheduled tee time without penalty by using our online portal or calling the golf shop.
1.3 No-Show / Late-Cancellation Fee. If a reservation is not canceled or modified at least two (2) hours in advance, you authorize the Club to charge the full posted rack rate for each unused spot in the reservation to the card on file. (Example: a foursome that fully no-shows will be charged four times the applicable 18-hole rate.)

2. Golf Cart & Scooter Use Agreement

2.1 Assumption of Responsibility. You accept sole responsibility for the proper, lawful, and safe operation of any Club-owned golf cart, scooter, or other personal transport assigned to you.
2.2 Damage & Retrieval Costs. You agree to pay all costs arising from misuse or negligent operation, including but not limited to:

• Repair or replacement of damaged components (parts & labor); and

• A flat retrieval fee of $500 for any cart or scooter abandoned off-property or otherwise requiring extraordinary recovery efforts.
  2.3 Authorization to Charge. By signing these Terms, you expressly authorize the Club to charge the card on file or to invoice you for any amounts due under Section 2, which are payable upon demand.
  2.4 Rules of Operation. Drivers must hold a valid driver’s license, adhere to posted cart-path rules, and never exceed manufacturer passenger or weight limits. Operating a cart or scooter while impaired by alcohol or drugs is strictly prohibited.

3. Release of Liability & Indemnification

3.1 Acknowledgment of Risks. Golf involves inherent risks, including errant golf shots, uneven terrain, wildlife, weather, and the operation of carts or scooters. You choose to participate voluntarily.
3.2 Release. To the fullest extent permitted by law, you hereby release, waive, and discharge The Club at Brookstone, its owners, officers, employees, volunteers, affiliates, and agents (“Released Parties”) from all claims, liabilities, demands, causes of action, damages, or expenses (including attorneys’ fees) arising out of or related to (a) personal injury (including death), (b) property loss or damage, or (c) any other harm you may suffer while on Club property or participating in Club activities, even if caused in whole or in part by the negligence of the Released Parties.
3.3 Indemnification. You agree to defend, indemnify, and hold harmless the Released Parties from and against any claim or demand brought by any third party that is in any way connected to your acts, omissions, or use of Club facilities or equipment.
3.4 Medical Treatment. You authorize the Club to secure medical treatment deemed necessary in the event of an injury and agree to be responsible for all associated costs.

4. General Provisions

4.1 Compliance with Rules. You must follow all posted signage, USGA Rules of Golf, local rules, and staff instructions. The Club reserves the right to remove any person whose behavior it deems unsafe, disruptive, or otherwise contrary to these Terms—without refund.
4.2 Payment Authorization. You consent to the storage and use of your payment card information for charges authorized by these Terms.
4.3 Severability. If any provision is held invalid or unenforceable, the remaining provisions will remain in full force.
4.4 Governing Law & Venue. These Terms are governed by the laws of the State of South Carolina. Exclusive venue for any dispute shall be the state or federal courts located in Anderson County, South Carolina.
4.5 Modification. The Club may amend these Terms at any time. The version in effect at the time of your tee-time booking will govern that reservation. An updated version will be posted at the golf shop and on our website.
4.6 Entire Agreement. These Terms constitute the entire agreement between you and the Club regarding play and supersede all prior communications.

By booking or playing a round at The Club at Brookstone, you acknowledge that you have carefully read, fully understand, and voluntarily accept these Terms & Conditions, including the waiver of liability and authorization for payment.
